Definition of Pandering Obscenity Involving a Minor
- With knowledge of the character of the material or performance,
- Creating, reproducing, or publishing erotic or otherwise obscene material,
- Portraying a minor.
Defense
Pandering obscenity is not illegal, if the material can be sold for medical, scientific, educational, or other related purposes.
Potential Penalty
Pandering obscenity involving a minor can be treated as a felony of the second, third, or fourth degree. As such, a finding of guilt in a court of law can result in a penalty of 6 months to 8 years in prison and a fine up to $15,000.
