Elements of Sexual Battery

  • Engaging in sexual conduct with someone who is not a spouse;
  • By using a means that would prevent resistance; or
  • With knowledge of impairment; or
  • Taking advantage of an authoritative position over a minor.

Sexual battery is essentially taking advantage of a person by coercion or because a person’s judgment is obviously impaired. This sex crime is distinguished from rape in that there does not need to be any force or threat of force.

Potential Penalties

Sexual battery is a felony of the third degree, which carries with it a sentence of 1-5 years in prison and a maximum penalty of $10,000.
