Columbus Sexual Battery Lawyer
ORC § 2907.03
Elements of Sexual Battery
- Engaging in sexual conduct with someone who is not a spouse;
- By using a means that would prevent resistance; or
- With knowledge of impairment; or
- Taking advantage of an authoritative position over a minor.
Sexual battery is essentially taking advantage of a person by coercion or because a person’s judgment is obviously impaired. This sex crime is distinguished from rape in that there does not need to be any force or threat of force.
Potential Penalties
Sexual battery is a felony of the third degree, which carries with it a sentence of 1-5 years in prison and a maximum penalty of $10,000.
At Funkhouser Law, we know everyone accused of sexual battery has the presumption of innocence. However, these are very serious charges and, as such, we work hard to accomplish the most favorable outcome for each of our clients.
If you have been accused of sexual battery, please call Funkhouser Law for a free consultation with an experienced, peer-rated lawyer.
