Defined

  • A person who is not a drug manufacturer, wholesaler, pharmacist, owners of pharmacy, or licensed health professional authorized to prescribe drugs,
  • Knowingly furnishing,
  • a sample drug.

Potential Penalties

Illegal dispensing of drug samples is typically a felony of the fifth degree and can be punished by a sentence of 3-11 years in prison and a fine of up to $20,000.
