Possessing Nitrous Oxide in a Motor Vehicle

Defined
- Possessing an open cartridge of nitrous oxide
- While operating, or being a passenger in, a motor vehicle, or
- While being in a stationary vehicle.
Potential Penalty
Possessing nitrous oxide in a motor vehicle is a misdemeanor of the fourth degree and can be penalized by up to 30 days in jail and a fine of up to $250. In addition, the court may suspend for up to five years the offender’s driver’s or commercial driver’s license or permit.
