Ohio Field Sobriety Tests

After a motorist is stopped, an officer may request that the motorist submit to a variety of field sobriety tests (FST). The most common of these tests include the horizontal gaze test (placing a pen in front of the driver’s eye to see whether or not the eye is “jumpy” or “bouncy”), having the driver walk and turn, and having the driver stand on one leg. Even when the officer correctly administers the FST, these tests are not completely reliable. There are high margins of error associated with each of these tests and a variety of factors other than alcohol can cause a driver to “fail” the FST. Although they are commonly used as part of the prosecutor’s evidence against the driver, field sobriety tests may not be a reliable indicator of intoxication.
