Offenses Ineligible for Expungement

Although most misdemeanors and some felonies qualify for expungement, there are certain exceptions. The following convictions are some general categories of offenses that may be ineligible for expungement:

  • convictions where the offender is subject to a mandatory prison term
  • convictions for crimes that are considered sexual assaults and displays, offenses of prostitution, and offenses related to distribution of obscene material to juveniles
  • convictions of an offense of violence and the offense is classified as a first degree misdemeanor or a felony (there are many exceptions to this rule)
  • convictions of an offense where the victim was a minor and the offense is classified as a misdemeanor of the first degree or a felony
  • convictions of felony offenses that are classified as felonies of the first or second degree
  • convictions for failure to pay child support
  • many driver’s license convictions (including DUI and OVI convictions) and bail forfeitures in traffic cases

Although this is a general overview of the ineligible types of offenses, each of these categories are complex and include multiple exceptions.
