Driving With an Invalid Operator's License

Under Ohio law, it is illegal to operate a motor vehicle without a valid driver’s license or with a driver’s license that has expired. The circumstances surrounding the violation will determine how the offense is classified. If the driver has never had a driver’s license, the violation is classified as a first degree misdemeanor carrying the possible penalties of six months in jail and/or a one thousand dollar fine. If the driver has a driver’s license that has been expired for more than six months at the time of the offense, the violation is classified as a fourth degree misdemeanor carrying the possible penalties of thirty days in jail and/or a two hundred and fifty dollar fine. If the driver has a driver’s license that has been expired for less than six months, the violation is classified as a minor misdemeanor and carrying the possible penalty of a one hundred and fifty dollar fine. If a driver has been convicted of driving without a valid license multiple times during the past three years, the classification of the violation may be enhanced and the possible penalties increased.
