FRA Suspension

Any driver or vehicle owner who fails to show proof that financial responsibility (insurance) was in effect at the time of an accident or traffic offense can lose his/her driving and registration privileges for a minimum of 90 days up to 2 years. The length of the license suspension will be 90 days for the first offense, one year for a second offense and two years for third and subsequent offenses committed within a five-year period. A person may also be charged with this violation by failing to respond to a letter from the Bureau of Motor Vehicles requesting proof of financial responsibility.

If you have had your driving privileges taken away because you failed to show proof of insurance at the time of your accident, contact our Columbus traffic violation attorney today!

Approximately five percent of registered Ohio vehicles owners are randomly selected to receive letters from the BMV. Recipients have 21 days to submit proof of insurance to the BMV. The registration and license plates of the motor vehicle involved may be impounded when the defendant is the owner of the vehicle. In order to regain driving and registration privileges, the individual must serve the suspension time imposed, file and maintain proof of financial responsibility insurance, and pay the required reinstatement fee.

The offense of driving under FRA suspension is a first degree misdemeanor and carries criminal penalties as well as implications on a driver’s license. If a driver is charged with driving under FRA suspension three or more times within five years, the court may order that the driver permanently forfeit the vehicle. Further, a charge of driving under FRA suspension carries the possibility of a one thousand dollar fine and up to six months in jail. It is important to hire an experienced attorney who is able to explore possible defenses against this violation and minimize the potential penalties that may result.
