DUI With a CDL

A conviction of driving under the influence (OVI or DUI) will have serious consequences on a driver’s CDL. This is true whether the DUI conviction occurred while operating a CMV or a private vehicle.

If a driver is convicted of DUI (or OVI) while operating a private vehicle, the Bureau of Motor Vehicles (BMV) will automatically impose a one year CDL suspension. This BMV suspension is separate from the license suspension imposed by the court. A second DUI or OVI conviction will result in a lifetime CDL suspension.

The rules are even harsher if the DUI occurs while the driver is operating a CMV. Although the legal limit of blood alcohol concentration (BAC) while operating a private motor vehicle is .08%, a commercial DUI includes having a BAC of only .04% or higher. Further, a twenty-four hour CDL suspension will be imposed if any discernable amount of alcohol is in the driver’s system. If the driver submits to a breathalyzer and is over the .04% legal limit, the driver must surrender his or her CDL on the spot to the police officer. The first DUI conviction will result in a one year CDL suspension. A second DUI conviction may result in a lifetime CDL suspension.
