Driving Under Suspension (DUS)

If your license has been suspended, you are not lawfully allowed to operate a motor vehicle until you reinstate your license. This usually requires paying a hefty reinstatement fee to the Ohio Bureau of Motor Vehicles (BMV), providing the BMV proof of insurance, and may even require you to retake the entire driver’s license examination. Driving while your license is suspended is a serious offense. DUS is classified as a first degree misdemeanor. A DUS citation carries with it six points on the individual’s driver’s license, a fine of up to one thousand dollars, and even the possibility of up to six months in jail.

Have you had your driver's license suspended due to a traffic violation? If so, contact our Columbus traffic ticket attorney today.

Additionally, driving someone else's car while under suspension could expose that pe rson to criminal liability for permitting you to drive (called “wrongful entrustment”), which exposes them to immobilization, forfeiture penalties, and points on their license under a separate statute.

Unfortunately, many drivers charged with DUS are caught without knowledge of the suspension. Others are driving because of an emergency situation requiring that they operate a vehicle. However, the vast majority of people drive their vehicles even though they know that their driver's licenses are suspended because they need to keep their jobs and take care of their families. License suspension can occur under a lot of different circumstances, and it is important to hire an experienced Ohio traffic ticket attorney who is able to present the driver’s point of view to the court and fight to minimize the potential penalties.
