Is Domestic Violence a Serious Crime?

Domestic violence is a very serious crime. There are three ways that law enforcement officials may charge a person accused of domestic violence. The first type of domestic violence charge police may file against an individual is a fourth degree misdemeanor. A fourth degree misdemeanor carries a potential maximum sentence of 30 days in jail, a two hundred and fifty dollar fine, and the possibility of probation. This type of charge is often used where there are allegations of verbal threats. The second, and most common, type of domestic violence charge is a first degree misdemeanor. A first degree misdemeanor carries a potential maximum sentence of 180 days in jail, a one thousand dollar fine, and the possibility of probation. An individual is usually charged with a first degree misdemeanor when there are accusations of physical assault. A third type of domestic violence charge, and the most serious, is classified as a felony. A domestic violence felony carries the potential of a significant prison sentence and is filed when an individual has a previous conviction for domestic violence. Any one of these three types of domestic violence charges can result in hefty fines, significant jail time, and long-lasting consequences on a person’s life.
