Disobeying Traffic Control Devices

Drivers are required to follow and obey “traffic control devices”, including both posted signs on the roadways and stop lights. Failure to do so can result in a citation of not obeying traffic control devices. This offense is classified as a minor misdemeanor carrying the possible penalty of a one thousand dollar fine and 2 points on a driver’s license. The charge can be enhanced to a fourth degree misdemeanor if the driver has been convicted of one other traffic offense during the past year. A fourth degree misdemeanor carries the possibility of a two hundred and fifty dollar fine and thirty days in jail. A citation for failing to obey traffic control devices can be further enhanced to a third degree misdemeanor if the driver has been convicted of two or more traffic offenses during the past year. The potential penalties increase to a fine of five hundred dollars and/or up to sixty days in jail.
