Columbus Reckless Driving Attorney

“Reckless driving” is generally defined as the operation of an automobile in a dangerous manner under the circumstances. Common reasons for being charged with reckless operation include excessive speeding, driving too fast for the conditions even if within the posted speed limit, having too many passengers in the car, weaving or cutting in and out of traffic, failing to yield to other vehicles, driving a car known to have dangerous flaws such as faulty brakes, and a variety of other acts.

  • speeding in excess of 20 mph over the speed limit

The offense of “reckless operation” is a four-point violation. This offense is generally classified as a minor misdemeanor, carrying a potential fine of one hundred and fifty dollars. The classification may by enhanced to a fourth degree misdemeanor if the driver has been convicted of another traffic offense within the past year. The potential penalties are also increased to a fine of up to two hundred and fifty dollars and/or up to 30 days in jail. The violation may be further enhanced to a third degree misdemeanor if the driver has been convicted of two or more traffic offenses within the past year. Accordingly, the potential penalties again increase to a fine of up to five hundred dollars and/or up to sixty days in jail.
