There are various degrees of murder, for which a person can be charged. It typically depends on the particular state laws in which he or she is being held. The punishments can vary, based on the degree and can include prison sentences, life sentences and in extreme cases- the death penalty. The following are the widely accepted degrees of murder and their meanings:

  • First Degree: This charge must prove that the suspect committed the crime in a pre-meditated manner. Often, another felony such as arson or rape will be committed in conjunction with this crime.
  • Second Degree: The murder was not pre-meditated, but it was intentional.
  • Third Degree: The suspect had intention to harm, but not to kill. In several states this can be called manslaughter, which has its own degrees of severity.

If a suspect wishes to claim innocence, he or she will need to provide a believable alibi-, which is a story that places him or her away from the murder scene at the time of the crime. This can be achieved by bringing reliable witnesses to the stand to testify for the suspect. However, if an alibi cannot be obtained, there are several defenses that will either lighten or remove the sentence from the suspect. A person can plead guilty to a murder case, but give a justifiable reason for his or her actions.

Insanity, post-partum depression, self-defense and diminished capacity are all acceptable defense positions for murder. Also, if a suspect can prove that he or she committed the crime unintentionally, they may be able to lessen the degree of the murder charge to manslaughter or recklessness charge. This will decrease the chance of serving a lifetime sentence in prison or receiving the death penalty. Often the best way to avoid a heavy sentence is to plead guilty, but to provide a worthy defense.
