If you have a commercial driver's license (CDL), there are a whole different set of rules you drive by. If you do not follow these rules, you may cost yourself your career. Drivers who have a CDL are subject to special laws and special rules regarding driving under the influence (OVI or DUI) with a CDL. Your CDL may be suspended for certain traffic violations, including some that occur in your private vehicle. These suspensions may last anywhere from 24 hours to life. A CDL may be suspended for a “short” period of time following convictions for serious traffic violations. There are two classifications of serious traffic violations: those that happen while driving a commercial motor vehicle (CMV) and those that happen while driving in a private vehicle. The first classification of serious traffic violations includes driving a CMV without a CDL, driving a CMV without carrying your CDL, and residing in Ohio for thirty days and driving a CMV with an out of state CDL. The second classification of serious traffic violations includes speeding by 15 miles per hour or more, reckless operation of a motor vehicle, failing to drive within marked lanes, and a variety of other traffic offenses. A sixty day CDL suspension will automatically be imposed if a driver is convicted of any two serious traffic violations within a three year period. The CDL suspension will last one hundred and twenty days if the driver is convicted of any three serious traffic violations within three years. A driver’s CDL may also be suspended for violating railroad crossing laws. This type of suspension may last from sixty days to one year depending on the number of prior offenses.

One year CDL suspensions are imposed in many cases that involve common traffic violations. A one year CDL suspension will be imposed upon the driver’s first conviction of any of the following offenses: use of any motor vehicle to commit a felony, driving under the influence (OVI or DUI), operating a CMV with a suspended CDL, failing to submit to a blood, breath, or urine test, failing to stop after an accident (hit-and-run), and a variety of other offenses.

A CDL may be suspended for life in the case of certain traffic violations. These include two or more convictions for any of the following offenses: use of a motor vehicle to commit a felony, failing to submit to a blood, breath, or urine test, operating a CMV with a suspended CDL, driving under the influence (DUI), failing to stop after an accident (hit-and-run), and a variety of other offenses. A CDL may also be suspended for life after the first conviction of using a motor vehicle in the manufacture or distribution of a controlled substance.

CDL suspensions are very serious and are imposed on top of criminal penalties the driver may face.
