Assured Clear Distance Ahead (ACDA)

Ohio law prohibits a driver from operating a motor vehicle at a greater speed than will permit a person to bring the vehicle to a stop within the assured clear distance ahead (ACDA). Common reasons for receiving an ACDA citation include speeding through a construction zone, driving over 20 miles per hour in a school zone, and other speeding violations on the freeway.

ACDA is a two-point violation. Although it is dependent on the facts surrounding the citation, ACDA is usually classified as a minor misdemeanor, carrying a maximum penalty of a one hundred and fifty dollar fine. This classification may be enhanced to a fourth degree misdemeanor or even a third degree misdemeanor if the driver has been convicted of other similar traffic offenses during the previous year. The penalties are enhanced accordingly: a fine of up to two hundred and fifty dollars and/or up to thirty days in jail for a fourth degree misdemeanor and a fine of up to five hundred dollars and/or up to sixty days in jail for a third degree misdemeanor.
